vehicle encumbered Page 283

An “encumbered” vehicle has finance owing on it—the loan is secured against the car, and the debt follows the VIN, not the seller. Buy without sorting that out and the lender can repossess your new pride and joy faster than you can say “where’s the spare key?”. In Australia, check it with a PPSR search using the VIN; it only costs a few dollars and gives a certificate showing financial interests plus write‑off/stolen status. If money’s owing, settle it at or before purchase—pay the lender directly, get a payout letter and a receipt, and keep the PPSR certificate. Private sale? Don’t hand over cash until the encumbrance is cleared and the paperwork is in your hot little hands. It’s the cheapest peace of mind you’ll ever buy for a car.
